Terms & Conditions/Waiver & Release of Liability READ BEFORE AGREEING By checking off the box below, I/we (Parent/Guardian of Participant and/or Participant) agree to the following terms and conditions of participating in the Programs provided by Royal Saint Lawrence Yacht Club (RStLYC) 1. Medical Condition & Authorization. I certify that the named Participant is physically able to participate RStLYC programs. and that I know of no restrictions, physical impairments, or any other facts, which in any manner limit his/her participation in such a program. I also understand that RStLYC will administer no physical examinations and that RStLYC will rely solely upon the information submitted via forms. I give permission for Participant to receive emergency medical or surgical treatment and hospitalization if necessary. I hereby authorize directors, coaches, staff and associates of RStLYC to act on my behalf according to their best judgment in any emergency requiring medical or surgical treatment and hospitalization if necessary. 2. Financial Responsibility & Insurance. I will be financially responsible for any medical attention needed during the program duration or resulting from an injury received at during program participation. I represent that I have provided and maintain adequate health and medical insurance coverage for Participant covering any and all activities related to the program participation. My medical insurance shall be the insurance coverage for any medical treatment. I also understand and agree that RStLYC shall not assume, or be responsible or liable for, expense, medical treatment, or compensation for any injury to the named Participant that may suffer during Program participation or related activities. 3. Compliance with Program Participation Rules. Participant understands and agrees to comply with all of the RStLYC rules, policies and stated and customary terms, conditions or requirements for participation (Program Participation Rules), including any rules or conditions of any hotel or transportation service provider that the participant uses during their program participation. I/we agree that if you observe any unusual or significant concern in the participant’s readiness for participation in the Program or the participant’s failure or unwillingness to comply with the Program Rules, you may, at your sole discretion, remove the participant from the participation and immediately inform the nearest RStLYC official. Also, I/we hereby release and forever discharge RStLYC from any and all claims, actions, damages, or liabilities (including attorneys' fees and costs), arising from or related to any acts, actions, failures to act by Participant or Participant's disregard or failure to follow Program Rules. 4. Assumption of Risk of Program Activities. I understand the risk of injury to Participant from the activities involved in Program activities is significant, including the potential for permanent disability and death. The term “Program Activities” includes but is not limited to: travel to and from, activities on land and water, activities before and after instruction at any hotel or third-party facilities at which a Program activity or function is conducted. While the particular Program rules, equipment and personal discipline may reduce this risk, the risk of serious injury does exist. I/we (Parent/Guardian and Participant) knowingly and freely assume all such risks, both known and unknown, even if arising from the negligence of RStLYC, and its Coaches, Instructors, Staff, Management, and Directors, and I/we assume full responsibility for participation in the Program by Participant. 5. Release & Hold Harmless. I/we for myself and on behalf of Participant hereby release and hold harmless RStLYC., and its Coaches, Staff, Management, Directors, Sponsors, Representatives, volunteers and if applicable the owners and lessors of the premises used to conduct Programs (Releasees) with respect to any and all injury, disability, death or loss or damage to person or property incident to participant’s involvement or participation in any and all Program activities whether arising from the negligence of releases or otherwise, to the fullest extent permitted by law. 6. Indemnity. I/we, for myself and on behalf of Participant, hereby indemnify and hold all of the above Releasees from any and all liabilities incident to Participant’s involvement or participation in any and all Program activities, whether arising from the negligence of releases or otherwise, to the fullest extent permitted by law. 7. Payment: Registration must be paid in full prior to attending Programs. Payment can be made in full at the time of registration. 8. Cancellation Policy: 8a: By Provider RStLYC reserves the right to cancel a Program for any reason without prior notice. In this case, a full refund is given for all monies collected by RStLYC only. RStLYC will not be responsible for refunds on airline flights, hotel reservations, or other incidental fees incurred in conjunction with the Program. 8b: By Registrant 50% if within one (1) month of the start date 9. Publicity. I understand and agree RStLYC, retains the right to use, for publicity and advertising, photographs of Program Participants taken during Program participation. 10. Limitation of Liability: I agree that the total liability of RStLYC, its affiliates and respective directors, coaches, instructors, officers, employees, and agents with respect to services performed or to be performed by RStLYC, shall not exceed 100% of the compensation received by RStLYC, from me pertaining to Participant. The parties agree and acknowledge that this Section of the Agreement is a material part of the consideration for the Agreement. 11. Severability. In the event that any provision of these Terms and Conditions, or the application of any such provision to any person or set of circumstances, shall be determined to be invalid, unlawful or unenforceable, the remainder of these Terms and Conditions shall continue to be valid and enforceable to the fullest extent permitted by law. 12. Governing Law & Jurisdiction. These Terms and Conditions will be governed by the law of the jurisdiction in which the Program is conducted. I/we agree that any action brought under these Terms and Conditions shall be brought in the jurisdictional court. In the event either party commences an action under these Terms and Conditions, the prevailing party shall be entitled to reasonable attorneys' fees and costs. Conditions générales – Renonciation et décharge de responsabilité À LIRE AVANT D’ACCEPTER En cochant la case ci-dessous, je/nous (parent/tuteur du participant et/ou participant) reconnais/sons avoir lu et compris les présentes conditions générales et accepte/ons d’être lié(e)(s) par celles-ci relativement à la participation aux programmes offerts par le Yacht-Club Royal Saint-Laurent (YCRStL) (le « Club »). 1. État de santé et autorisation de soins. Je certifie que le participant nommé est physiquement apte à prendre part aux programmes du Club et que je ne connais aucune restriction, limitation, affection ou autre fait pouvant, de quelque façon que ce soit, limiter sa participation. Je comprends que le Club ne procède à aucun examen médical et qu’il se fie uniquement aux renseignements fournis dans les formulaires. J’autorise le participant à recevoir, au besoin, des soins médicaux d’urgence et/ou un traitement chirurgical ainsi que l’hospitalisation. J’autorise par la présente les administrateurs, entraîneurs, instructeurs, employés et représentants du Club à agir en mon nom, selon leur meilleur jugement, en cas d’urgence nécessitant des soins médicaux et/ou chirurgicaux et/ou une hospitalisation. 2. Responsabilité financière et assurance. Je serai financièrement responsable de tout soin médical requis pendant la durée du programme ou découlant d’une blessure survenue lors de la participation au programme. Je déclare maintenir une couverture d’assurance maladie et médicale adéquate pour le participant couvrant l’ensemble des activités liées à la participation au programme. Mon assurance maladie constituera la couverture applicable à tout traitement médical. Je comprends et accepte également que le Club n’assume aucune responsabilité et ne soit tenu de payer quelque dépense, traitement médical ou compensation relativement à toute blessure que le participant pourrait subir pendant la participation au programme ou à toute activité connexe. 3. Respect des règles de participation. Le participant comprend et accepte de respecter l’ensemble des règles, politiques et conditions, écrites ou usuelles, applicables aux programmes du Club (les « Règles »), incluant toute règle ou condition de tout hôtel, transporteur ou autre fournisseur tiers utilisé dans le cadre du programme. Si le Club constate une préoccupation inhabituelle ou importante quant à l’aptitude du participant à prendre part au programme, ou un manquement/refus de se conformer aux Règles, le Club peut, à sa seule discrétion, retirer le participant du programme et en aviser sans délai un représentant du Club. Je/nous décharge/ons en outre le Club de toute réclamation, action, dommage ou responsabilité (y compris les honoraires et frais juridiques raisonnables) découlant des actes, omissions, manquements ou de l’inobservation des Règles par le participant. 4. Acceptation des risques. Je comprends que les activités visées par les programmes comportent des risques importants de blessure, incluant notamment une invalidité permanente ou le décès. Les « Activités » comprennent notamment, sans s’y limiter : les déplacements aller-retour, les activités sur terre et sur l’eau, ainsi que les activités tenues avant ou après l’instruction, y compris dans tout hôtel ou installation appartenant à un tiers où une activité ou fonction du programme est tenue. Bien que l’encadrement, les règles, l’équipement et la discipline personnelle puissent réduire certains risques, le risque de blessure grave demeure. Je/nous (parent/tuteur et participant) accepte/ons sciemment et volontairement l’ensemble de ces risques, connus ou inconnus, même s’ils résultent de la négligence du Club, de ses entraîneurs, instructeurs, employés, dirigeants ou administrateurs, et j’assume/nous assumons l’entière responsabilité de la participation du participant au programme. 5. Renonciation, décharge et exonération de responsabilité. En mon nom et au nom du participant, je/nous renonce/ons irrévocablement à toute réclamation et décharge/ons le Club, ainsi que ses entraîneurs, instructeurs, employés, dirigeants, administrateurs, commanditaires, représentants et bénévoles, et, le cas échéant, les propriétaires et locateurs des lieux utilisés pour tenir les programmes (collectivement, les « Bénéficiaires de la décharge »), à l’égard de toute blessure, invalidité, décès, perte ou dommage, matériel ou corporel, découlant de ou lié à la participation du participant à toute Activité, qu’elle résulte de la négligence de l’un ou l’autre des Bénéficiaires de la décharge ou autrement, dans toute la mesure permise par la loi. 6. Indemnisation. En mon nom et au nom du participant, j’indemnise et tiens indemnes les Bénéficiaires de la décharge de toute responsabilité, réclamation, demande, perte, dommage, coût ou dépense (y compris les frais et honoraires juridiques raisonnables) découlant de ou lié(e) à la participation du participant à toute Activité, qu’elle résulte de la négligence de l’un ou l’autre des Bénéficiaires de la décharge ou autrement, dans toute la mesure permise par la loi. 7. Paiement. Les frais d’inscription doivent être payés en totalité avant la participation aux programmes. Le paiement peut être effectué intégralement au moment de l’inscription. 8. Politique d ’annulation. 8a : Annulation par le Club Le Club se réserve le droit d’annuler un programme, pour quelque motif que ce soit, sans préavis. Dans un tel cas, un remboursement intégral sera accordé uniquement à l’égard des sommes perçues par le Club. Le Club ne sera pas responsable de tout remboursement relatif aux billets d’avion, réservations d’hôtel ou autres frais accessoires engagés en lien avec le programme. 8b : Annulation par l’inscrit (participant/parent/tuteur) Remboursement de 50 % si l’annulation survient dans le mois (1) précédant la date de début du programme. 9. Publicité. Je comprends et accepte que le Club conserve le droit d’utiliser, à des fins de publicité et de promotion, des photographies des participants prises dans le cadre de la participation au programme. 10. Limitation de responsabilité. Je conviens que la responsabilité totale du Club, de ses sociétés affiliées et de leurs administrateurs, dirigeants, entraîneurs, instructeurs, employés et mandataires respectifs, relativement aux services rendus ou à rendre par le Club, n’excédera pas 100 % des montants versés au Club par moi relativement au participant. Les parties reconnaissent que la présente clause constitue une considération essentielle de l’entente. 11. Dissociabilité. Si une disposition des présentes conditions est jugée invalide, illégale ou inapplicable, en tout ou en partie, les autres dispositions demeureront valides et exécutoires dans toute la mesure permise par la loi. 12. Droit applicable et compétence. Les présentes conditions sont régies par les lois de la province et/ou du territoire où le programme est tenu, ainsi que par les lois fédérales du Canada qui y sont applicables. Je/nous convenons que toute action ou procédure découlant des présentes conditions devra être intentée devant un tribunal compétent du ressort où le programme est tenu. Si l’une ou l’autre des parties intente une procédure relativement aux présentes conditions, la partie ayant gain de cause aura droit au remboursement de ses frais et honoraires juridiques raisonnables, dans la mesure permise par la loi.
